State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The rule is that a challenge benefits only the person who brings it and may be invoked only against the person against whom it is brought. Exception. A judgment concerning an indivisible subject matter, a joint and several obligation, or an action in which the law requires specified persons to be joined. A judgment debtor who missed the time limit for challenge or accepted the judgment may challenge it during consideration of a challenge brought by a co-party, joining that party's requests. Failure to do so. The court must order that person's joinder. The legislature's purpose is to unify adjudication in the same proceedings. This concerns public policy. - A dispute over the validity or nullity of a judgment awarding a sale. An indivisible subject matter admitting no multiplicity of solutions. Failure to join the two successful bidders in the appeal against the judgment, and the court's failure to order their joinder therein. Its effect. Nullity of the judgment. 6- Public Prosecutor's appeal against a criminal judgment imposing a fine:-
