Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2928

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Filing an appeal. Its effect. Transferring the subject matter of the dispute in its entirety to the Court of Appeal and placing it before that court anew, together with its legal grounds and factual evidence. Consequence: the Court of Appeal may, of its own motion, remedy clerical errors occurring in the appealed judgment and rule in accordance with the correct position. The Court of Appeal's statement that the court of first could have made the correction. A superfluous digression without which the judgment stands.
