A request to set aside the appealed judgment. Implicitly and necessarily includes a request for judgment dismissing the action. A request to return the assignment to the expert does not affect this. Reason therefor. A judgment dismissing the action in that event does not constitute an award of relief not sought by the litigants.

طلب إلغاء الحكم المستأنف. يندرج فيه ضمناً وبطريق اللزوم طلب الحكم برفض الدعوى. لا يؤثر في ذلك طلب إعادة المأمورية للخبير. علة ذلك. الحكم برفض الدعوى عندئذ لا يكون قضاء بما لم يطلبه الخصوم.Original Arabic judgment citations
