Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2953

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Court of Appeal. Is not confined to addressing the judgment appealed against. It must exercise its review over the work of the court of first instance, whether concerning facts or the application of law. No fault attaches to it if it does not refute what that court inferred from the case papers and evidence. It suffices that its ruling has an established basis in the papers and rests on grounds justifying it.
