State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Definition of mental deficiency under Article 945 of the Majalla and the statements of jurists. Assessment of the existence of mental deficiency is a matter for the court of merits. The act of a mentally deficient person is like that of a discerning minor; permission may not be given by anyone other than the guardian. The Majalla does not require that the mental deficiency be generally known before registration of the interdiction order or that the other contracting party have knowledge thereof.
