An action for judicial divorce on grounds of harm. Basing it before the court of first instance on desertion and refusal to provide maintenance. Adding a new ground on appeal, namely assault by beating and insult. Reversal of the first-instance judgment rejects it on the basis of the grounds raised at both levels of litigation. No error. The rationale for this.
