Kuwait Court of Cassation principle number 3142

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

New claims may not be made on appeal. A fundamental rule relating to public policy. An exception permits adding wages, salaries, all ancillary amounts, and increases in compensation to the original claim after final submissions have been made before the court of first instance. The judgment's contravention of this rule and its rejection of the claim for additional compensation for the aggravation of injuries. A violation of the law requiring its cassation.
