Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 318

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Acts of sovereignty are those undertaken by the government, motivated by considerations relating to the State's high policy, in its capacity as a governing authority, not an administrative authority. All are outside the jurisdiction of the courts. Example concerning the expulsion of two Jordanian servicemen from military service and their lack of entitlement to any dues.
