The respondent may bring an incidental appeal against the appellant. The condition therefor. That he has allowed the appeal period to expire or accepted the judgment before his opponent filed the principal appeal. The rationale therefor. The respondent's belief that his opponent acquiesced in the judgment rendered. The rationale is absent if the incidental appellant had previously filed a principal appeal within the time limit. - The permissibility or impermissibility of an incidental appeal. A matter pertaining to public policy. The court rules on it of its own motion. An example of the impermissibility of an incidental appeal because a principal appeal had previously been filed.
