Kuwait Court of Cassation principle number 3321
State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The plaintiff's or appellant's failure to attend the hearing does not prevent determination of either. The condition for this. Example. The Court of Appeal's proceeding to determine the action and not ordering it struck out for the female appellant's absence. - The judgment's omission of a statement that the plaintiff knew of the hearings scheduled for consideration of his action. Does not vitiate it where the papers contain evidence that such knowledge was established. Thirteenth: Intervention by the Public Prosecution at first instance does not dispense with its intervention on appeal
