Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3617

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Appeal against an arbitral award. The general rule is that it is not permissible. The means of challenging it is an independent action for annulment in certain exhaustively specified cases. These cases must not be used as a means of challenging the award on the same grounds that would constitute grounds for appeal. - Inadequacy of the judgment’s factual reasons invalidates it. Inadequacy or error in its legal reasons does not invalidate it but renders it tainted by an error of law. An example concerning an arbitral award’s error in applying the rule of relativity, thereby placing it outside the cases of nullity.
