State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Conclusive proof that harm has occurred. Sufficient for the court to decree divorce. Referral of the dispute to two arbitrators. Its condition: failure to establish harm or inability to demonstrate it, with the wife insisting on divorce. Article 127 of Law 51 of 1984 concerning Personal Status, as amended. - A request for referral to evidentiary investigation is not a right of the parties. The court may disregard it whenever it finds in the papers sufficient material to form its conviction and render it unnecessary. An example of sound reasoning for a judgment granting divorce without appointing two arbitrators or referring the action to evidentiary investigation. 8- Arbitration pursuant to the Arbitral Tribunals Law No. 11 of 1995:-
