Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 758

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The trial court is not obliged to follow the litigants through all aspects of their defenses and respond to them separately. An implicit response suffices. - A request to conduct an evidentiary hearing is not a right of the litigants but a discretionary measure that the court may decline to grant. Its condition: that it finds in the case papers sufficient material to form its conviction. The Court of Appeal may refrain from granting this request where the court of first instance referred the action for an evidentiary hearing and the litigants failed to produce their witnesses.
