Kuwait Court of Cassation principle number 887

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Provisions of laws. Their application to what occurs from their effective date. The effect of the new law may not extend to procedures that occurred and situations that materialized before it came into force. - A procedural act validly completed under the old law. Its adjudication as valid under the new law even if the latter considers it invalid. Example concerning the amendment of the Legal Profession Law 42 of 1964 by Law 62 of 1996, effective from 22/12/1996, requiring statements of claim in actions whose value exceeds five thousand dinars to be signed by a lawyer. - A manifestly invalid defence. No reproach attaches to the judgment if it does not answer it.
