English translation of the principle
Summary: - Judicial police officer. Nature of his task. Article 39 of the Criminal Procedure and Trials Code. - The appellant’s publication and writing of his tweets containing offensive expressions on the social networking site—Twitter—which everyone without distinction can access and read and view what is published there. The protection prescribed by Article 31 of the Constitution concerning the confidentiality of private postal, telegraphic and telephone communications, and the protection prescribed by Article 78 of the Criminal Procedure and Trials Code, do not extend to them. Reason for this. - The incident officer’s access to social networking sites and viewing what is published there. No violation. Reason: they are available to everyone without any need to obtain an order for that purpose. Rule: It is established that, pursuant to Article 39 of the Criminal Procedure and Trials Code, the duties of judicial police officers include detecting offences and identifying their perpetrators. Every procedure undertaken for that purpose is valid and produces its effects, provided that the officer has not, by his act, intervened to create the offence or incite its commission, and provided that the perpetrator’s will has not been extinguished. The facts of the case were that the appellant published and wrote his tweets containing offensive expressions on the social networking site—Twitter—which everyone without distinction can access and read and view what is published there. Consequently, the protection prescribed by Article 39 of the Constitution concerning the confidentiality of private postal, telegraphic and telephone communications does not extend to what is published on those sites. Nor does the protection prescribed in the concluding part of Article 78 of the Criminal Procedure and Trials Code, safeguarding the inviolability of the foregoing in implementation of the Constitution, extend to them. Those things enjoy privacy which no one may inspect, unlike the situation in the present case. The incident officer’s access to social networking sites and viewing what is published there does not violate the Constitution and the law, since they are available to everyone. Accordingly, his subsequent monitoring of what the appellant published on that site does not violate the law, nor does he need to obtain an order for that purpose from the competent authority. Since the challenged judgment reached this conclusion, justifying the procedure undertaken by the incident officer, the challenge to it in this respect is incorrect.

Original Arabic judgment citations
