Kuwait Court of Cassation principle number 159

English translation of the principle
Summary: - Reducing the legally prescribed punishment to a lesser degree. The court is not obliged to state the grounds and reasons therefor. Reason: leniency is a feeling within the judge. The law has not required him to explain it. Disputing this is impermissible. Rule: It is established that assessment of the grounds for leniency or their absence, assessment of punishment within the limits prescribed by law, and application of the circumstances the court regards as aggravating or mitigating fall within its discretion. In taking those circumstances into account, it considers the criminal incident established before it against the accused. It is also established that, if the judge wishes to exercise leniency and reduce the legally prescribed degree of punishment to a lesser degree, he is not obliged to state the grounds therefor or the reasons for imposing punishment to the extent he considered appropriate. Leniency is an inward feeling aroused in the judge by various causes which he sometimes cannot identify so as to express them in writing or speech. Therefore, the law has not required him—and could not have required him—to explain them; rather, it accepts his mere statement that this feeling exists within him, without requiring proof thereof. Accordingly, since the punishment imposed by the challenged judgment upon the first, second, and fifth respondents falls within the limits of the punishment prescribed for the offence carrying the severest punishment of which it convicted them, namely financing terrorism, this falls within its unfettered discretion and may not be disputed before the Court of Cassation. The appellant's contention that, in assessing punishment, the trial court did not take into account the justifications referred to in the ground of challenge is therefore likewise inadmissible.

Original Arabic judgment citations
