English translation of the principle
Summary: - Settlement is a contract by which a dispute between two parties concerning a particular subject is resolved. It must not be interpreted expansively and must be confined to the subject matter of the dispute it addressed, to the exclusion of any other. Its implication. A settlement presented before the criminal court has no effect before the civil judiciary hearing the civil action arising from the harmful act, unless that settlement expressly provides for the injured party's waiver of his right to compensation arising from the criminal action. Merely stating that the heirs forgave the appellant in respect of the incident of their decedent's death, without anything indicating their waiver of their right to compensation for the damage they sustained as a result of their decedent's death. Insufficient. Rule: It is established that settlement is a contract by which a dispute between the two parties concerning a particular subject is resolved. It must therefore not be construed expansively, and its interpretation must be confined to the subject matter of the dispute it addressed, to the exclusion of any other. Accordingly, a settlement presented before the criminal court has no effect on the dispute brought before the civil judiciary hearing the civil action arising from the harmful act where that settlement does not expressly provide for the injured party's waiver of his right to compensation arising from the criminal action. That being so, and in addition to the appellant's failure to deposit the document supporting this defence pursuant to Article 153 of the Law of Procedure, what is established from the face of the document portfolio submitted by the appellant before the court of first instance, which contained an indication that the victim's heirs had forgiven the appellant in respect of the incident of their decedent's death, is that it contained nothing indicating their waiver of their right to compensation for the damage they sustained as a result of their decedent's death, and from, the objection on this ground is unfounded.

Original Arabic judgment citations
