English translation of the principle
Liability insurance is insurance of a debt owed by the insured. Insurance for the account of an interested party. A stipulation for the benefit of a third party that creates a direct personal right for the beneficiary to the insurance amount. - The injured party’s direct recourse against the insurer outside the case of compulsory insurance and liability for motor vehicle accidents. Its condition is that the policy contain a stipulation for the benefit of a third party. The judgment’s lack of evidence of its existence and disregard of the defence relating thereto constitute deficient reasoning.
