State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The ship’s agent represents the maritime carrier; he must hold Kuwaiti nationality and be registered in the register of the Ministry of Communications. His obligation to deposit a bank guarantee at a Kuwaiti bank. Its purpose. Enabling interested parties to enforce judgments issued in their favour against the foreign carrier. - The legislature’s regulation of commercial agencies relating to ships’ agents does not affect the rules of commercial agencies, the manner and grounds of their formation, or the methods of proving them. - Issuance of the Minister of Communications’ decision pursuant to the Maritime Commerce Code improving the bank guarantee that ships’ agents are required to deposit and requiring the register to contain a statement of the temporary agency contract or its instrument and a statement of its limits. Purpose thereof. What matters in applying this provision is the date on which the law took effect, not the decision which it authorised to determine the amount of the guarantee.
