Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1936

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The appellant's insistence that the two respondents be required to return what they received without right, because they failed to perform their obligation to sign the sale contract, whereby they were enriched without lawful cause at his expense. Establishment of the absolute nullity of the contract because it included a contract for the sale of a business that was not embodied in an official instrument. The challenged judgment's dismissal of the action on the basis that the rules of enrichment could not be applied because a contractual relationship existed. An error in the application of the law which prevented it from restoring the action to its correct legal characterization.
