Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2228

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that contracts are consensual. Mere mutual consent of the contracting parties suffices for their formation. The form of a contract prescribed by law constitutes an essential element of the contract. It must be observed upon contracting. Failure to do so entails the nullity of the contract and the agreements connected with it.
