State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The debtor's failure to perform his contractual obligation. A fault giving rise to his liability. His proof that non-performance is attributable to force majeure, an external cause in which he had no part, or the other contracting party's fault. It absolves him of liability. Example of an external cause: labour unrest at the factory producing the commodity agreed to be supplied from Italy.
