Licensing the opening or ownership of an establishment or office for the purpose of engaging in trade or practising a profession and craft. Its condition is that the licensee be a Kuwaiti owning the establishment's capital or a share thereof of no less than 51%, and be responsible for management. This pertains to public policy, with absolute nullity ensuing as the sanction for its violation.

الترخص بفتح أو تملك منشأة أو مكتب بقصد الاشتغال بالتجارة أو مزاولة مهنة وحرفة. شرطه أن يكون المرخص له كويتياً مالكاً لرأسمال المنشأة أو لحصة منه لا تقل عن ٥١ ٪ وأن يكون مسؤولاً عن الإدارة. تعلق ذلك بالنظام العام وبما يرتب البطلان المطلق جزاء مخالفته.Original Arabic judgment citations
