State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The notice that interrupts prescription. Article 370 of the former Commercial Code. The instrument addressed by the creditor to the debtor demanding the rights owed to him by the latter. A defence unrelated to public policy that was not previously asserted before the court of merits. A new ground that may not be invoked before the Court of Cassation. Example: arguing for the first time that a letter was sent as evidence of discussions to settle the compensation matter and constitutes a moral impediment to bringing the action.
