Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 309

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

What the Civil Code provides concerning joining the seller in an action asserting superior title to the thing sold, failing which the purchaser's right to warranty against eviction lapses, and its absence of the rule restricting the purchaser's right, in cases of total or partial eviction, to recovery of the price eviction only if the seller succeeds in proving that, at the time of sale, he did not know the cause of eviction. The former Commercial Code's absence of similar provisions. Does not prejudice the purchaser's right to compensation encompassing the loss he sustained and the profit he missed, even if he did not join the seller.
