State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The creditor’s recourse against the surety under a commercial suretyship. It is not conditional upon first making a claim against the debtor. The consequence thereof. He has the option of making a claim against either of them or against both together. His recourse against one does not extinguish his right to claim against the other. If there are multiple sureties, the one who has paid may have recourse against the others for his share in the debt and his portion of the share of any insolvent surety among them, whether by a personal action or an action by subrogation.
