Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3154

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The regulation of the practice of ship agency contained in the Maritime Commercial Code is intended to enable interested parties to enforce judgments issued in their favor against foreign carriers. This regulation does not affect the provisions governing how agency is formed, terminated and proved. The bank guarantee or cash deposit which the ship agent is obliged to deposit with a bank secures enforcement of judgments issued against the sea carrier from the entry into force of the Maritime Commercial Code.
