Kuwait Court of Cassation principle number 3426

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Appeal in cassation. In principle, it is limited to judgments issued by the Court of Appeal and final judgments, whatever the court that issued them, if they determined a dispute contrary to another judgment previously issued between the same litigants and having acquired the force of res judicata. The exception. Its nature: cases specified by law by way of exception. - Decisions issued by the Arbitration Committee at the Kuwait Stock Exchange. Final and enforceable and may not be challenged by any of the methods of challenge set out in the Code of Procedure. This is not altered by the permissibility of appeal in cassation against arbitral awards issued by the Judicial Arbitration Panel constituted pursuant to Law 11 of 1995 concerning Judicial Arbitration. The rationale therefor: this appeal is limited to the latter and does not extend to others.
