State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Multiple debtors for a single debt and differing sources of each debtor’s obligation. The consequence. They are all liable for performance of the obligation, and the creditor may demand the entire debt from any one of them individually, since they are bound in solidum for the debt. No debtor benefits from establishment of another’s liability so long as that debtor’s own liability has been established. - The creditor’s obtaining a judgment against one debtor. This does not deprive the creditor of the right to claim against another debtor or the remaining debtors. Condition: the creditor has not obtained satisfaction from the first judgment debtor. The appealed judgment’s contravention thereof. A violation and misapplication of the law requiring its cassation. - Joint and several liability of the debtor:-
