State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Cassation appeals against judgments rendered by the Court of Appeal. Permissible regardless of the subject matter in which - 130 - Commercial the challenged judgment was rendered, whenever it is based on a violation of the law or an error in its application or interpretation, or where a nullity occurred in the judgment or proceedings that affected the judgment. The exception: litigants may appeal by the same route against any final judgment, regardless of the court that rendered it, if it decided a dispute contrary to another judgment previously rendered between the same litigants and having acquired the force of res judicata. The appeal being directed against the challenged judgment rendered by the Court of Appeal and not against the decision of the Arbitration Committee of the Kuwait Stock Exchange. Permissible. The plea that it may not be heard. Incorrect.
