A lawsuit cannot proceed properly unless the opposing party is formally notified. Service of court documents is the justice system’s means of safeguarding the right to a defence.

The Importance of Proper Service

Without service on the opposing party, litigation proceedings are invalid. Service is the only means of ensuring that the other party knows about the lawsuit and has an opportunity to respond.

The law imposes strict service procedures to protect the rights of all parties and prevent judgments from being issued in a party’s absence because that party was unaware of the lawsuit.

How Are Court Documents Served?

Service is usually carried out by process servers, who visit the address stated in the statement of claim to deliver the documents.

If the opposing party is not present at that address, the Civil and Commercial Procedure Law provides alternative methods to ensure delivery of the notification.

What Should You Do If You Receive a Statement of Claim?

If you are served with a lawsuit, do not neglect it. Ignoring service does not stop the proceedings and may result in a judgment being issued against you in your absence.

Contact a lawyer immediately to present your defence within the prescribed time limit.

Checking the Validity of Service

You can track the status of service and court cases through the Kuwaiti Ministry of Justice’s electronic systems.

If there is any doubt about the validity of service, you must raise it promptly before the court as a procedural objection, before addressing the merits of the dispute.

Consequences of Neglect

Failing to monitor service notifications or update your details may cause you to miss important legal deadlines, which could result in losing the case.

Provide accurate details to the court and check service notifications regularly.
