If the husband refuses to provide maintenance to his wife despite his ability to do so, she may bring her matter before the judge, who shall notify him that he must do one of two things: either provide maintenance or divorce. If he refuses both and cannot be compelled to do either, the judge shall, at her request, divorce her by one irrevocable divorce in accordance with the Jaafari school.
