يشترط في العاقد أمور ثلاثة:
1 - البلوغ فلا يصح عقد الصبي المميز وإن كان بإذن الولي.
(١) الفقرة الأخيرة مضافة بالمرسوم رقم ١١ لسنة ٢٠٢٥
٢ - العقل فلا عبرة بعقد المجنون وإن كان جنونه إدوارياً إذا أجرى العقد في دور
جنونه.
