English translation
The testator may appoint an overseer over the executor and a supervisor of his work. His function is subject to the testator’s designation, and it is of two types: First: To appoint the overseer as a monitor of the executor for the purpose of ascertaining that his implementation of the will conforms to what was bequeathed, such that, if he sees him acting contrary to what the testator prescribed, he would object to him. The executor is not required to seek the permission of such an overseer for his dispositions or follow his opinion and view concerning them; rather, his acts must merely be performed with his knowledge and supervision. Second: To appoint the overseer as a consultant to the executor such that he acts only with his permission and approval. Although the executor is an independent guardian in disposition and execution, he is not independent in opinion and judgment, and none of his acts shall take effect except those that accord with the overseer’s view and have his permission. If he acts alone according to his own view without the overseer’s approval, his disposition shall not take effect.

Ask about this article
