The validity of the endower’s conditions requires certain matters: First: Connection with the contract, meaning that the condition is undertaken in the body of the contract; if it was agreed upon before the contract, that shall not suffice to make the stipulated obligation binding. Second: That it not be incompatible with the requirements and nature of the contract. يعتبر في صحة شروط الواقف أمور:
الأول : الاقتران بالعقد، بمعنى أن يلتزم به في متن العقد فلو اتفق عليه قبل العقد
لم يكف ذلك في الالتزام المشروط به .
الثاني : أن لا يكون منافيا لمقتضى العقد وطبيعته، فلو شرط الواقف أن تبقى العين
على ملكه، فيبيعها أو يهبها أو يؤجرها متى شاء ، فهذا الشرط مخالف لمقتضى العقد
وباطل ومبطل.
الثالث : أن لا يكون مخالفا للكتاب والسنة أو على خلاف حكم من أحكام الشريعة
الإسلامية، كأن يشترط فعل الحرام أو ترك الواجب.
الرابع : أن لا يكون مجهولا.
الخامس : أن يكون الشرط مما فيه غرض معتد به عند العقلاء نوعا، أو بالنظر إلى
