Article 40 of Personal Status Law

a- If the marriage contract is coupled with a condition incompatible with its essence, the contract shall be void. b- If it is coupled with a condition that is not incompatible with its essence but is incompatible with its implications, or is prohibited under Sharia, the condition shall be void and the contract valid. (1) The last paragraph of the Article was added pursuant to Law No. 29 of 2004 Law Index 1138 Home Page Personal Status Law Law No. 51 of 1984 concerning Personal Status c- If it is coupled with a condition that is incompatible with neither its essence nor its implications and is not prohibited under Sharia, the condition shall be valid and must be fulfilled. If it is not fulfilled, the person in whose favour it was stipulated shall have the right to seek annulment. d- The provision of the preceding paragraph shall apply where the specified characteristic stipulated in either spouse is absent.
