Article 209 of Commercial Code

1 - The air carrier shall be liable for damage occurring in the event of destruction, loss, or damage to baggage or goods if the accident that caused the damage occurred during carriage by air. 2 - Carriage by air includes the period during which the baggage and goods are in the carrier's custody during flight or while the aircraft is at an airport or at any other place where it has landed Law Index 1282 Home Page . 3 - Carriage by air does not include the period during which the baggage or goods are subject to carriage by land, sea, or river outside the airport. However, if such carriage takes place in performance of carriage by air for the purpose of loading, delivery, or transfer from one aircraft to another, the damage must be presumed to have resulted from an accident occurring during the period of carriage by air until evidence to the contrary is established.
