Article 1 of Domestic Workers Law

In this Law, the following words and expressions shall have the meanings indicated opposite each: 1 - Domestic worker: Every male or female assigned manual work inside private residences (and the like) for the account of individuals pursuant to a written contract. 2 - Employer: The person with whom the domestic worker takes up employment pursuant to a contract prepared by the Ministry of Interior. 3 - Offices subject to the provisions of this Law: Domestic labour recruitment offices licensed to conduct the activity by the Ministry of Interior. 4 - Overseas offices: Offices sending domestic labour, located outside the State of Kuwait, licensed to conduct the activity of sending domestic labour by the official authorities in those countries and accredited by the embassies of the State of Kuwait therein. 5 - Domestic Labour Department: The Domestic Labour Department at the Ministry of Interior. Part Two Conditions for Issuing Licences to Offices Article 2 (1) The issuance and renewal of a licence to practise the profession of recruiting domestic labour from abroad shall be subject to the following conditions:- 1 - The licence applicant must be of Kuwaiti nationality, of commendable conduct and good reputation, and must not have been sentenced to a penalty for a felony or for an offence involving dishonour or breach of trust (1) The requirement contained in the text of clause (3) to obtain a general secondary school certificate for the issuance and renewal of a licence to practise the profession of recruiting domestic labour from abroad was ruled unconstitutional in Appeal No. 25 of 2015 Law Index 921 Home Page Domestic Labour Law Law No. 68 of 2015 concerning Domestic Labour unless he has been rehabilitated. 2 - His age must not be less than thirty years or more than 70 years. 3 -.... ((Ruled unconstitutional)). 4 - The licence applicant must submit a letter of guarantee from a local bank, and the amount of the guarantee shall be determined by a decision issued by the Minister of Interior. Companies in whose capital the State or its public institutions hold any share and which operate in the field of domestic labour recruitment may be licensed, provided that the company's profits do not exceed 10 as a return on the contributed capital. Companies whose activity is domestic labour recruitment may also be licensed.
