Article 138 of Private Sector Labour Law

Without prejudice to any more severe penalty prescribed by any other law, every employer who violates the provisions of the second paragraph of Article Ten shall be punished by imprisonment for a period not exceeding three years and a fine—for each worker—of not less than two thousand dinars and not more than ten thousand dinars, or by either of these two penalties. If the worker joins the service of another employer in violation of the provisions of the aforesaid Article (10), paragraph (2), the other employer shall be punished by the same penalty set out in the preceding paragraph of this Article, without prejudice to the administrative authority's right to deport the offending worker.
