State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Understanding the facts of the action and assessing evidence and documents. For the trial court. Its basis. That it bases its ruling on sound reasons and that its reasoning leads to the conclusion it reached. An example concerning a judgment basing its ruling establishing mental deficiency, prodigality, and heedlessness on presumptions and judicial judgments, while merely referring to those judgments without stating their purport, how it relied on them to establish the truth on which it based its ruling, or their effect in forming its conviction. Deficiency and unsound reasoning that vitiate it and require its cassation.
