The obligatory bequest takes precedence over the voluntary bequest. The consequence. If an estate contains an obligatory bequest and a voluntary bequest or bequests, the obligatory bequest is executed first; if it exhausts the entire third, the other voluntary bequests are void because their subject matter has ceased to exist.
