Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 161

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The final claims are decisive in determining the court's adherence to the limits of the claims submitted to it. - The judge's ratification of a settlement—in matters other than those relating to public policy—conclusively resolves the dispute. - The litigants' request to record what they have agreed upon by way of settlement concerning financial rights arising from the marriage contract, without contravening public policy. The dispute is thereby conclusively resolved and it may not be appealed. The judgment's adherence to this. No defect.
