Kuwait Court of Cassation principle number 181

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Marriage of a Muslim woman to a non-Muslim man. A void marriage producing none of the effects of a valid marriage. Its condition. Establishment of knowledge of the prohibition and its reason. Ignorance is not regarded as an excuse where its assertion cannot be accepted from a person such as the one asserting it. - A void contract. Produces no effect. A void marriage contract produces none of the effects of marriage, even after consummation. It is regarded as nonexistent, so that no filiation is established by it and no waiting period is required following it. - Maliki jurisprudence requires, for the validity of a marriage contract with a Muslim woman, that the husband be Muslim. A non-Muslim’s contract is not valid, is void, and does not require annulment. An irregular marriage contract must be annulled unconditionally, even if effected using the word divorce. Reason therefor.
