The wife's maintenance. The condition for its being obligatory. That she surrender herself to her husband, even constructively. Its basis: the valid marriage contract by which she is reserved for the husband's right; her maintenance is therefore payable from his property even if she is in her father's house, ready to obey him, and she is regarded as such from the time of the contract. Her refusal to do so without justification. Its effect: the husband may obtain a judgment requiring her to enter into his obedience. That judgment becoming final, being served upon her, and her failure to execute it. She is regarded as maritally disobedient and her maintenance is forfeited. - 387 - Personal Status
