Annulment of marriage for desertion. Its difference from a request for judicial divorce for conflict and discord between the spouses. - Requesting a judgment of judicial divorce for desertion, not for conflict and discord, and the absence of this latter request from the case papers. Its effect: transfer of the action to the appellate court with its evidence and defenses and within the limits of the appellant’s requests. The judgment’s determination that the action’s scope falls outside a request for separation for conflict or discord. No defect.
