A wife's request for separation on grounds of discord, made in her objection to an obedience notice because the disagreement between her and her husband has become entrenched, under Egyptian law. Its distinction from the cause of action in a suit for judicial divorce on grounds of harm. Its necessary consequence. A judgment dismissing an action for judicial divorce on grounds of harm does not preclude hearing the wife's action seeking separation on grounds of discord.

طلب الزوجة التفريق للشقاق المبدي في اعتراضها على إنذار الطاعة لاستحكام الخلاف بينها وبين زوجها في القانون المصري. اختلافه عن السبب في دعوى التطليق للضرر. لازم ذلك. أن الحكم برفض دعوى التطليق للضرر ليس بمانع من نظر دعوى الزوجة بطلب التفريق للشقاق.Original Arabic judgment citations
