Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 580

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court must exert its utmost effort to reconcile the spouses before granting divorce for harm. Offering reconciliation before the court of first instance and its rejection by either spouse suffices to establish its failure to reconcile them. Its implication. There is no need to offer it again before the Court of Appeal.
