State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The husband may take back his revocably divorced wife by word or deed solely of his own will. The condition for this. That she is within the waiting period. Its implication. This right is not extinguished by waiver. The reason therefor: it entails a change to God's law. Taking back by words. Its nature. It includes express words without intention and writings that depend upon intention. - Verbal taking back. Its condition. That it be immediate, in the presence of two male witnesses or one man and two women, or by official attestation, and that the wife be informed of it. - Taking back in writing is a form of verbal taking back. - The presumption is that no taking back has occurred. Whoever relies on what is established originally, apparently or presumptively does not bear the burden of proof; rather, it lies on whoever alleges what is contrary to the original, apparent or presumed position.
