Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 7

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Subject-matter jurisdiction is attributed in principle to the Court of First Instance, not to its circuits. Assignment of particular actions to the court’s various circuits by a decision of its general assembly. Merely an administrative allocation and not a question of subject-matter jurisdiction. - The jurisdiction of one of the court’s circuits to hear particular matters pursuant to a special statutory provision. Does not preclude its jurisdiction to hear other matters falling within the court’s subject-matter jurisdiction. Example concerning personal status circuits.
