Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 878

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that if the female custodian and the ward’s guardian disagree on matters other than his care, such as directing him toward a particular type of education or trade, the decision belongs to the guardian. The father’s guardianship over his children is constrained by consideration and welfare. - The judge has general guardianship and is entitled to supervise those vested with special guardianships. If one of them exceeds the limits of his guardianship, the judge may withdraw, restrict, or limit that guardianship and disregard any act of the guardian that prejudices the minor’s interests. - Assessment of the extent of the guardian’s adherence to his child’s interests. A matter for the trial court. Its condition. - Challenging the court’s assessment that the appellant’s transfer of his children from private foreign schools to public education despite his affluence is detrimental to their future. A factual argument beyond the scrutiny of the Court of Cassation.
